Terms & Conditions
These Terms & Conditions ("Terms") govern your use of Abspokephoto services, including the Artist Monthly Content Subscription, one‑off shoots, and any related products (collectively, the "Services"). By booking a shoot, subscribing, or submitting your details through this website, you agree to these Terms.
1. Who We Work With
Abspokephoto provides content creation services primarily for recording artists and creators. You confirm that you are at least 18 years old (or have written consent from a parent or legal guardian) and legally able to enter into this agreement.
2. The Subscription Offer & Artist Package
The core offer is the Artist Package, a monthly content subscription where we meet with you once per month to create music video, short‑form content, and/or photography. Each subscription cycle generally includes:
- A 2.5–3.5 hour videography session for either a music video or short‑form content, at up to two locations no more than approximately 30 minutes apart.
- Delivery of the agreed video assets, including either a full music video (with one draft / edit pass) or up to fifteen (15) short‑form pieces if the focus of the session is shorts.
- A photography component (typically up to 1.5 hours) with up to ten (10) lightly retouched images. You may bring multiple outfits, and we can shoot at up to two locations per meet‑up, again within reasonable travel time.
- All editing for the agreed deliverables, plus ideation, production input, and general guidance on how to use the content.
The exact mix of music video, short‑form content, and photography for a given month may vary based on your goals and what we agree to focus on for that session, and the scope may be updated from time to time on the checkout page or in your written communications with us.
3. Scheduling, Rescheduling & Arrival
We will work with you to agree on a shoot date, time, and locations for each month. You are responsible for arriving on time and prepared. If you arrive more than fifteen (15) minutes late without prior notice at least two (2) hours before the call time, we may either shorten the session, charge a reasonable late fee (for example, a $20 late fee), or treat the session as used for that month. We understand that emergencies happen, but we also need to protect our time and production schedule.
If you need to reschedule, you must contact us as early as possible using the contact details we provide. We reserve the right to limit reschedules or charge a rescheduling fee if changes are frequent or last‑minute. Weather, technical issues, or other factors beyond our control may require us to move or adjust a shoot; in that case we will work with you to find a new date.
4. Payments, Minimum Term & Billing
Subscription payments are processed through our third‑party payment provider (such as Square) and are billed at the price and cadence shown at checkout (for example, currently starting at $249/month, subject to change). By completing checkout, you authorize recurring charges to the payment method on file until the subscription is cancelled in line with these Terms.
Because the pricing is heavily discounted compared to typical single‑video project rates, the Artist Package normally requires a minimum commitment of five (5) consecutive months. If you ask to terminate your subscription before the end of this minimum term, we may charge a reasonable early‑termination fee (for example, $500) to account for the discounted rate and pre‑planning involved. All amounts are in US dollars unless otherwise stated and are generally non‑refundable once a shoot has been scheduled or delivered, except where required by law.
5. Cancellations of Subscription by You or Us
You may request to cancel your subscription by contacting us using the details on this site or through our CRM / booking system. Cancellation will typically take effect at the end of your current billing period and, if applicable, once any minimum‑term obligations or early‑termination fees have been satisfied. You remain responsible for any outstanding balances.
We may cancel or suspend your subscription at any time if you violate these Terms, engage in unsafe or abusive behavior, fail to make required payments, or otherwise make it unreasonable for us to continue providing the Services. In those circumstances, we are not obligated to refund past payments, but we will communicate clearly about any remaining obligations on either side.
6. Creative Direction & On‑Set Conduct
Abspokephoto controls the technical and creative direction on set, but we will collaborate with you on concepts, locations, and styling. You agree not to request or engage in any illegal, dangerous, hateful, or discriminatory activity during a shoot. We may immediately stop a session if we believe safety, legal, or reputational risks are present; in that case no refund is owed for the affected session.
7. Ownership & Usage of Content
Unless otherwise agreed in writing, you receive a non‑exclusive, royalty‑free license to use the final delivered photos and videos for your own music releases, social media, promotion, and personal branding. Abspokephoto retains copyright in the underlying footage, edits, and project files and may use excerpts for our portfolio, website, ads, and social channels, unless you and Abspokephoto agree in writing to restrict certain usage.
8. Artist Likeness & Releases
By booking a session, you grant Abspokephoto permission to record and use your image, voice, and likeness in the content we create. If other people appear on camera (such as featured artists or extras), you are responsible for ensuring they have consented to be filmed and that we may use their likeness as part of your project.
9. Delivery of Content
We will deliver final edited assets through cloud storage links, file‑transfer tools, or our CRM platform. Approximate turnaround times will be communicated during or after your shoot and may vary depending on the scope of work and our active project load.
10. No Guarantees of Results
We can help you show up more consistently and professionally, but we cannot guarantee specific outcomes such as views, streams, followers, or revenue. Any examples or testimonials we share are illustrative only and do not promise similar results for every artist.
11. Limitation of Liability
To the fullest extent permitted by law, Abspokephoto will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services. Our total liability for any claim related to the Services will not exceed the amount you paid to us for the specific session or subscription period giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Abspokephoto and our team from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your breach of these Terms, (b) your misuse of the content we deliver, or (c) any materials, music, locations, or people you direct us to include in your shoot.
13. Third‑Party Services
We use third‑party tools to process payments, host files, manage bookings, and send communications (for example, Square and CRM/automation platforms). Your use of those tools may be subject to their own terms and policies, which you should review separately.
14. Governing Law
These Terms are governed by the laws of the State of New York, USA, without regard to conflict of law principles. Any dispute will be handled in the state or federal courts located in New York County, New York, unless otherwise required by law.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services or applicable laws. When we do, we will update the "last updated" date at the bottom of this page. Continued use of our Services after an update means you accept the revised Terms.
